2. Definitions

• “Products” means the cosmetic and beauty products offered for sale on the Site.
• “Order” means a request submitted by you to purchase Products.
• “Order Confirmation” means our email or message confirming that we have accepted your Order.
• “Content” means all text, images, video, graphics, logos, shade names and other material on the Site.

3. Eligibility & your account

You must be at least 18 years of age and capable of forming a legally binding contract under the Indian Contract Act, 1872, to purchase from us. If you are below 18, you may use the Site only under the supervision of a parent or legal guardian who agrees to these terms on your behalf.

You may need to create an account to place an Order. You are responsible for keeping your login details confidential and for all activity under your account. Please give us accurate, current and complete information, and keep it updated. We may suspend or close any account that we reasonably believe has been used in breach of these terms.

4. Products, shades & pricing

Our Products are cosmetics formulated for the skin. Each Product page describes the Product, its finish and how to use it.

Shade and colour representation

We try to display shades, finishes and packaging as accurately as possible. However, the colour you see depends on your screen, lighting and settings, and how a shade appears on skin varies by individual skin tone and undertone. Minor variations between the on-screen image and the actual Product are not a defect.

Pricing

• All prices are listed in Indian Rupees (INR) and are the Maximum Retail Price (MRP), inclusive of applicable Goods and Services Tax (GST), unless stated otherwise. Shipping charges, where applicable, are shown at checkout before you pay.
• We may change prices, run offers, or revise Product descriptions at any time without prior notice. The price that applies to your Order is the price shown at the time you place it.
• Despite our best efforts, a Product may occasionally be mispriced or its details may contain an error. If we discover an error in the price or description of a Product you have ordered, we will contact you and may cancel the Order and refund any amount paid.

We may decline or cancel any Order, in whole or in part, including where:

• the Product is out of stock or no longer available;
• there is an error in the price or description of the Product;
• we are unable to deliver to the address provided;
• we suspect the Order is fraudulent, made by a reseller, or placed in breach of these terms; or
• quantity limits per customer or per Order apply.

If we cancel an Order for which you have already paid, we will refund the amount paid using the original payment method.

You confirm that the payment details you provide are valid and belong to you. Your payment is also subject to the terms of the relevant payment provider. Where Cash on Delivery is offered, an additional handling fee will be displayed at checkout.

7. Shipping & delivery

We ship in line with our Shipping Policy, which sets out delivery areas, processing times, charges and estimated timelines. Delivery timelines are estimates and are not guaranteed. Risk in the Products passes to you on delivery to the address you provide.

8. Cancellations, returns & refunds

Because our Products are cosmetics, returns are limited for hygiene and safety reasons. Your rights to cancel, return and obtain a refund are set out in full in our Returns & Refunds Policy, which forms part of these terms. Nothing in these terms limits the rights available to you as a consumer under the Consumer Protection Act, 2019.

9. Cosmetic product use & safety

Our Products are for external use on the skin only and are intended to be used as directed on the packaging and Product page. They are cosmetics, not medicines, and are not intended to diagnose, treat, cure or prevent any condition.

• We recommend a patch test before first use. Apply a small amount to your inner arm and wait 24 hours.
• Avoid contact with the eyes and broken or irritated skin. If contact occurs, rinse with water.
• If you experience irritation, redness or any adverse reaction, discontinue use and consult a medical professional.
• Always read the ingredient list before use if you have known allergies or sensitivities.
• Keep out of reach of children. Store as directed.

You are responsible for using the Products appropriately. Results may vary from person to person.

10. Intellectual property

All Content on the Site, including the Unblur Beauty name and logo, the “by Mehak” mark, product and shade names, photography, copy, design and layout, is owned by or licensed to Unblur Ventures Private Limited and is protected by Indian and international intellectual property laws.

You may view and use the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify or exploit any Content, or use any of our trademarks, without our prior written consent. The name, image and likeness of our founder and celebrity makeup artist are used under licence and may not be reproduced.

11. Reviews & user content

You may be able to submit reviews, ratings, photos or other content. By submitting content, you confirm it is your own, is accurate, and does not infringe anyone’s rights or any law. You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce and adapt that content across our marketing and channels, with attribution where reasonable.

We may moderate, edit or remove any user content at our discretion, and we are not responsible for content submitted by users. Please do not post anything unlawful, misleading, abusive or that contains personal data of others.

• use the Site for any unlawful, fraudulent or harmful purpose;
• resell our Products without authorisation, or place bulk Orders for resale;
• attempt to gain unauthorised access to, interfere with, or disrupt the Site or its security;
• use any bot, scraper or automated means to access or copy the Site or its data; or
• infringe our or any third party’s intellectual property or other rights.

Where our Products are listed on third-party marketplaces, the terms of that marketplace apply to those purchases in addition to ours.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law, including your statutory rights as a consumer.

Subject to the paragraph above and to your statutory consumer rights, our total liability to you in connection with any Order will not exceed the amount you paid for the Products giving rise to the claim.
